The transaction of the sale of the apartment

The transaction of the purchase or sale of housing is drawn up in the form of a contract of sale, which can be notarized or not. The last option is called a simple written form and has legal force. For the transaction to be fully perfect, it is necessary to register it.

The advantage of a simple form of the contract is the savings of funds to pay for notary services. In turn, the appeal to a specialist will increase the security of the transaction.

A number of documents will be required for the transaction:

– a technical passport for an apartment with a stages and explication;

– Property ownership certificate;

– information from the house book (extract);

– consent of the spouse, spouse or other owners (necessarily notarized) for sales or purchase;

– passports (you can provide other documents to certify the identity of the transaction participant);

– Documents of minor children living in the apartment sold, in this case, the guardianship authorities will require permission.

When drawing up a contract of sale, the data of the transaction participants indicate (take them from a passport or personality certificates).

Data on the object of the contract should allow us to clearly establish its location, purpose, size. The contract may indicate the cost of the apartment, as well as the terms and procedure for transferring funds.

The buyer is recommended to carefully read the seller’s documents, paying attention to the availability of signatures, seals, compliance with data, lack of shares and corrections.

Often the sale of the apartment is engaged in the seller’s confidant. In this case, he must have a notarized power of attorney. You can check its authenticity by contacting the notary who issued her.

After the contract has been signed, it is recommended to draw up an act of acceptance-gender. It must be specified in the parameters of the transferred housing (condition and number of rooms, type of heating, list of sanitary equipment). Such an act allows you to protect the parties from the unscrupulousness of the buyer, as well as the seller.

The final stage of the transaction is state registration. For this, the application is submitted and all the original documents with copies, the duty is paid. The result of registration is the issuance of the certificate. From this moment on, the new owner becomes the full owner of the purchased apartment.
